SmartBudgetNotes respects the intellectual property rights of others and expects the same from anyone who uses the Site. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

Reporting copyright infringement

If you believe material on [ smartbudgetnotes] infringes your copyright, send a written notice to our designated agent with the following:

1. Your physical or electronic signature (or that of a person authorized to act for you)
2. A description of the copyrighted work you claim has been infringed
3. The exact URL(s) of the material you want removed or disabled
4. Your name, mailing address, phone number, and email address
5. A statement that you have a good-faith belief that the use isn’t authorized by the copyright owner, its agent, or the law
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner

Please note that knowingly submitting false claims of infringement can expose you to liability for damages, including costs and attorney’s fees.

What happens next?

When we receive a valid notice, we will promptly remove or disable access to the material and may notify the person who posted it. We may also forward your notice, including your contact details, to that person.

Counter-notice

If you believe your content was removed by mistake or misidentification, you may send a counter-notice to the same agent. It must include:

1. Your physical or electronic signature
2. Identification of the material that was removed and where it appeared before removal
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed because of a mistake or misidentification
4. Your name, address, and phone number, and a statement that you consent to the jurisdiction of the courts in your district (or, if outside the US, in [COUNTRY]) and will accept service of process from the person who filed the original notice

If we receive a valid counter-notice, we may restore the material after 10 to 14 business days unless the original complainant informs us that they’ve filed a court action.

Repeat infringers

We may terminate access for, or block, anyone we determine to be a repeat infringer.
